Common use of Department of Agriculture sampling Clause in Contracts

Department of Agriculture sampling. (a) The Client acknowledges that Viterra will make Bulk Wheat available for inspection by authorised officers of Department of Agriculture at the Client’s cost prior to Outturning Bulk Wheat onto a nominated Transportation Vehicle. (b) The Client acknowledges that the Department of Agriculture may disallow the loading of some portion of the Client’s Bulk Wheat at a Port Terminal for reasons of non-conformance to Department of Agriculture export conditions as outlined in the Export Control Xxx 0000 (Cth) (including detection of live insects, rodents and rattlepod). Viterra is not liable for any Loss incurred by the Client in relation to any failure to load any Bulk Wheat in these circumstances.
