Common use of Department Remedies in the Event of Default Clause in Contracts

Department Remedies in the Event of Default. ‌ Upon the occurrence of an event of default on the part of Contractor, the Department is entitled, at its sole discretion, to one or both of the following remedies: • Termination of this Contract; and • Institution of legal proceedings against Contractor to collect payment of any damages or sums owed by Contractor hereunder, including liquidated damages and the costs of re- procurement, and such equitable relief as is appropriate. In the event of Contractor’s default, all State agencies will be advised to not do business with Contractor without written approval from the Department’s Division of State Purchasing until such time as Contractor reimburses the State for all re-procurement and transition costs.
