Derivative Productions. Provided Creator is also attached in a production capacity and has the same or substantially similar economic rights as set forth in this Agreement, Angel shall have rights to market and distribute (on substantially the same terms as set forth in this Agreement) any and all remakes, sequels, prequels, series, serials, spin-offs or other derivative based in whole or in part upon the Content in any manner, by any means, and in all media now known or hereafter created (collectively, “Derivative Productions”). Notwithstanding the foregoing, Xxxxx agrees that Creator shall retain rights to any stage play or musical version and Angel shall have only a right of first negotiation /refusal to negotiate for the rights to such stage/musical versions.

Derivative Productions. Producer agrees to notify SAG-AFTRA if a Podcast is based on an existing property that is owned and/or controlled by a third party or that was originally produced for a different medium (a “Derivative Podcast”). The parties shall engage in good faith negotiations with respect to terms and conditions of employment of Performers on any Derivative Podcast.
Derivative Productions. In the event that the Producer wishes to make an English-language motion picture sequel or prequel of the Film or teleplay of the Film (“Subsequent Production”), the Producer warrants to the Owner that provided the Owner receives sole credit as the writer of the Film or shares credit with the director of the Film, the Owner shall have the right of first opportunity on a rolling basis to provide writing services for the screenplay for any such Subsequent Productions, subject to the distributor standard terms, conditions and contingencies (including, without limitation, network approval in relation to television productions) on terms not less favourable than those contained in this Deed with respect to any such Subsequent Productions and otherwise to be negotiated in good faith, provided that should no agreement be reached within thirty (30) business days of the offer, or if the Owner declines or the Owner is unavailable or no longer actively working in the motion picture industry as a writer, the Producer shall be under no further obligation to the Owner in respect to any such Subsequent Productions.
Derivative Productions. Teacher owns, exclusively, all rights to develop, produce, publish and/or distribute any and all derivative productions based on the Underlying Material (except for the Wake Ups), throughout the universe, in perpetuity, in all media, markets and languages and in any manner now known or hereafter devised.

  • Products Products available under this Contract are limited to Software, including Software as a Service, products and related products as specified in Appendix C, Pricing Index. Vendor may incorporate changes to their product offering; however, any changes must be within the scope of products awarded based on the posting described in Section 1.B above. Vendor may not add a manufacturer’s product line which was not included in the Vendor’s response to the solicitation described in Section 1.B above.
