Common use of Determination Final Clause in Contracts

Determination Final. (a) Subject to any Grievance being re-opened under clause 41.17 or any party taking proceedings in any court or tribunal of competent jurisdiction as permitted under this clause 41, the determination of the Grievance Tribunal shall be final and binding on the parties. (b) The parties must comply with any award or order of the Grievance Tribunal. A failure by a party to comply with an award or order of the Grievance Tribunal will constitute a breach of this Agreement.
