Common use of Developer-Furnished Materials Clause in Contracts

Developer-Furnished Materials. Only materials furnished by Developer and necessarily used in the performance of the Extra Work may be included in Extra Work Costs. The cost of those materials will be the cost to the purchaser—whether the purchaser is Developer, an Affiliate, or a Contractor—from the Supplier thereof, except as the following are applicable:
