Common use of Developer Operating Requirements Clause in Contracts

Developer Operating Requirements. (a) Developer shall comply with all provisions of NYISO tariffs and procedures, as amended from time to time, which apply to any aspect of the Merchant Transmission Facility’s operations and its participation in NYISO-administered markets. Tariff revisions and/or operating protocols with NYISO, PJM, the Connecting Transmission Owner, and Developer may need to be developed to incorporate the Merchant Transmission Facility into NYISO-administered markets and to coordinate the operational control of the facility. (b) Developer shall comply with Connecting Transmission Owner operating instructions and requirements, which requirements shall include the dedicated data circuits to be maintained by Developer in accordance with Article 8.1 of this Agreement. Operating instructions will be communicated by telephone, or such other means of communication as the Parties may agree upon.
