DEVELOPER’S CONSENT AND OBLIGATIONS. 9.1. The Developer HEREBY CONSENTS to the Owners, Fifth Owner and Residential Owners entering into this Deed and to the Site, Additional Main Band Colliery Land and Residential Land respectively being bound by the obligations contained in this Deed PROVIDED THAT the Developer shall only be liable for any breach of this Deed once it has acquired a legal interest in any part of the Site and/or Additional Main Band Colliery Land and/or the Residential Land (as the case may be).
