Common use of Direction Not to Take Water Clause in Contracts

Direction Not to Take Water. Where the Customer: (a) has committed a material breach of this Agreement; (b) is in arrears for payments for Charges for more than 2 months; (c) has breached this Agreement and has not reimbursed SunWater for costs incurred by SunWater in rectifying the breach; (d) has not provided the security required under clause 20; (e) has breached any of clauses 4(a), (c), (d), (e), 11.2, 11.5 or 11.10 then, SunWater may direct the Customer or any person diverting or taking the Customer’s Allocation, not to divert or take water under the Customer’s Allocation.
