Directory Assistance Listings Information. GTE will make available to NEN, at NEN’s request, GTE end-user and authorized LEC DA listing information stored in GTE’s DA database for the purposes of NEN providing DA service to its customers. Implementation of customized routing, pursuant to Article VII, Section 11 is required for NEN to provide DA Service for GTE Resold and Unbundled Port services. 7.1 DA Listing Information includes the listed names, addresses and telephone numbers of GTE and authorized LEC subscribers, except as otherwise provided herein. GTE DA listing information includes 800/888 listings, non-listed numbers and foreign listings within the GTE franchise. 7.2 GTE shall provide to NEN, at NEN’s request, DA listing information within sixty (60) Business Days after an order is received for that specific state. The DA listing information will be provided in GTE format via magnetic tape or National Data Mover (NDM) as specified by NEN. Updates to the DA listing information shall be provided on a daily basis through the same means used to transmit the initial load. DA listing information provided shall indicate whether the customer is a residence or business customer. 7.2.1 Such listings shall be confidential information pursuant to Article III of this Agreement and NEN will use the listings only for its DA services to its end-users. NEN is not authorized to release GTE’s DA listing information to any third party or to provide DA to any other party using GTE DA listing information, including NEN’s affiliates, subsidiaries or partners, except with the expressed written permission of GTE. In those instances where NEN’s affiliates, subsidiaries or partners also desire to use GTE’s DA listing information, each affiliate, subsidiary or partner must negotiate a separate contract with GTE to obtain the listings. 7.2.2 If NEN uses a third-party DA service for its end-users, NEN will ensure that such third party likewise treats the listings as Confidential Information pursuant to Article III of this Agreement, and uses them only for NEN end-user DA. 7.2.3 GTE will include NEN’s DA listing information in GTE’s DA data base which may be released to third parties which request GTE’s DA listing information, unless NEN provides GTE written notice within sixty (60) Business Days after the effective date of this Agreement that its DA listing information is restricted and should not be released to third parties. In the event that NEN does properly notify GTE that its DA listing information is restricted, GTE will so advise third parties requesting such information. 7.3 NEN agrees to pay GTE’s standard charges for the initial load and daily updates of GTE’s DA listing information, which will be provided upon request. 7.4 The Parties will work together to identify and develop procedures for database error corrections.

Implementation of customized routing, pursuant to Article VII, Section 11 is required for NEN SETI to provide DA Directory Assistance Service for GTE Resold and Unbundled Port services. 7.1 DA 8.1 Directory Assistance Listing Information includes is the listed names, addresses and telephone numbers of GTE and authorized LEC CLEC subscribers, except as otherwise provided herein. Excluded are listings for restricted LEC lines and non-published listingsCLEC lines. GTE DA directory assistance listing information includes 800/888 listings, non-non- listed numbers and foreign listings within the GTE franchise. GTE will also provide non-published listings subject to the following limitations: 8.1.1 GTE will provide the name and address for non-published listings along with a non- published indicator. GTE may also provide the full ten (10) digit telephone number on an interim basis only, until GTE, in its sole discretion, modifies its systems to preclude the delivery of the non-published telephone number. Following such modification, SETI agrees that the non-published telephone numbers will no longer be available. 7.2 8.1.2 SETI agrees to defend, hold harmless and indemnify GTE against any claims, damages or liabilities arising out of any complaint, suit or other action brought by third parties relating to the release by SETI of any non-published customer names, addresses or numbers. 8.2 GTE shall provide to NENSETI, at NEN’s SETI's request, DA directory assistance listing information within sixty (60) Business Days after an order is received for that specific state. The DA listing information will be provided in GTE format via magnetic tape or National Data Mover (NDM) as specified by NENSETI. Updates to the DA listing information shall be provided on a daily basis through the same means used to transmit the initial load. DA listing information provided shall indicate whether the customer is a residence or business customer. The rates to be paid by SETI to GTE for the initial load and daily updates will be provided upon request. 7.2.1 8.2.1 Such listings shall be confidential information pursuant to Article III of under this Agreement and NEN SETI will use the listings only for its DA directory assistance services to its end-end users. NEN SETI is not authorized to release GTE’s DA listing information to any third other party or to provide DA to any other party using GTE DA listing information, including NENSETI’s affiliates, subsidiaries or partners, except with the expressed written permission of GTE. In those instances where NENSETI’s affiliates, subsidiaries or partners also desire to use GTE’s DA listing information, each affiliate, subsidiary or partner must negotiate a separate contract with GTE to obtain the listings. 7.2.2 8.2.2 If NEN SETI uses a third-party DA directory assistance service for to its end-end users, NEN SETI will ensure that such third party likewise treats the listings as Confidential Information pursuant to Article III of under this Agreement, and uses them only for NEN end-user DACLEC directory assistance. 7.2.3 GTE 8.3 The Parties will include NEN’s not release DA listing information in GTE’s DA data base which may be released that includes the other Party's end user information to third parties without the other Party's written approval. The other Party will inform the Releasing Party if it desires to have the Releasing Party provide the other Party's DA Listing Information to the third party, in which request GTE’s DA listing informationcase, unless NEN provides GTE written notice within sixty (60) Business Days after the effective date of this Agreement that its Releasing Party shall provide the other Party's DA listing information is restricted and should not at the same time as the Releasing Party provides the Releasing Party's DA Listing Information to the third party. The rate to be released paid by the Releasing Party to third parties. In the event that NEN does properly notify GTE that its DA listing information is restricted, GTE will so advise third parties requesting other Party shall be no more than the direct costs of compiling such information. Implementation of customized routing, pursuant to Article VIIVI, Section 11 12 is required for NEN MFN to provide DA Service for GTE Resold and Unbundled Port services. 7.1 DA Listing Information includes the listed names, addresses and telephone numbers of GTE and authorized LEC subscribers, except as otherwise provided herein. Excluded are listings for restricted LEC lines and non-published listings. GTE will make available to NENMpower, at NENMpower’s request, GTE end-user and authorized LEC DA listing information stored in GTE’s DA database for the purposes of NEN Mpower providing DA service to its customers. Implementation of customized routing, pursuant to Article VII, Section 11 is required for NEN Mpower to provide DA Service for GTE Resold and Unbundled Port services. 7.1 . DA Listing Information includes the listed names, addresses and telephone numbers of GTE and authorized LEC subscribers, except as otherwise provided herein. Excluded are listings for restricted LEC lines and non-published listings. GTE DA listing information includes 800/888 listings, non-listed numbers and foreign listings within the GTE franchise. 7.2 . GTE shall provide to NENMpower, at NENMpower’s request, DA listing information within sixty (60) Business Days after an order is received for that specific state. The DA listing information will be provided in GTE format via magnetic tape or National Data Mover (NDM) as specified by NENMpower. Updates to the DA listing information shall be provided on a daily basis through the same means used to transmit the initial load. DA listing information provided shall indicate whether the customer is a residence or business customer. 7.2.1 . Such listings shall be confidential information pursuant to Article III of this Agreement and NEN Mpower will use the listings only for its DA services to its end-users. NEN Mpower is not authorized to release GTE’s DA listing information to any third party or to provide DA to any other party using GTE DA listing information, including NENMpower’s affiliates, subsidiaries or partners, except with the expressed written permission of GTE. In those instances where NENMpower’s affiliates, subsidiaries or partners also desire to use GTE’s DA listing information, each affiliate, subsidiary or partner must negotiate a separate contract with GTE to obtain the listings. 7.2.2 . If NEN Mpower uses a third-party DA service for its end-users, NEN Mpower will ensure that such third party likewise treats the listings as Confidential Information pursuant to Article III of this Agreement, and uses them only for NEN Mpower end-user DA. 7.2.3 . GTE will include NENMpower’s DA listing information in GTE’s DA data base which may be released to third parties which request GTE’s DA listing information, unless NEN Mpower provides GTE written notice within sixty (60) Business Days after the effective date of this Agreement that its DA listing information is restricted and should not be released to third parties. In the event that NEN Mpower does properly notify GTE that its DA listing information is restricted, GTE will so advise third parties requesting such information. 7.3 NEN . Mpower agrees to pay GTE’s standard charges for the initial load and daily updates of GTE’s DA listing information, which will be provided upon request. 7.4 . The Parties will work together to identify and develop procedures for database error corrections.

Directory Assistance Listings Information. GTE will make available to NEN, at NEN’s request, GTE end-user and authorized LEC DA listing information stored include listings in GTE’s DA ----------------------------------------- its directory assistance database for XXX end users in the purposes of NEN providing DA service to its customers. Implementation of customized routing, pursuant to same geographic area as GTE provides directory assistance for GTE end users as specified in Article VIIVI, Section 11 is required for NEN to provide DA Service for GTE Resold and Unbundled Port services3.4. 7.1 DA Listing Information includes the listed names, addresses and telephone numbers of GTE and authorized LEC subscribers, except as otherwise provided herein. Excluded are listings for restricted LEC lines and non-published listings. GTE DA listing information includes 800/888 listings, non-listed numbers and foreign listings within the GTE franchise. 7.2 8.1 GTE shall provide to NENXXX, at NEN’s ELI's request, DA listing information for purposes of XXX providing XXX-branded directory assistance services to its local customers, within sixty (60) Business Days after an order for such tape is received received, all published DA listings for that specific statestate via magnetic tape. The DA listing information Such listings will be provided in GTE format via magnetic tape or National Data Mover (NDM) Confidential Information under this Agreement and XXX will use the listings only for its directory assistance services to its end users. If XXX uses a Third Party directory assistance service to its end users, XXX will ensure that such Third Party likewise treats the listings as specified by NENConfidential Information under this Agreement, and uses them only for such directory assistance. Updates Changes to the DA listing information Listing Information shall be provided updated on a daily basis through the same means used to transmit the initial loadlist. DA listing information Listing Information provided shall indicate whether the customer is a residence or business customer. The rate to be paid by XXX to GTE will be reasonable and mutually agreed. 7.2.1 Such listings 8.2 The Parties will not release DA Listing Information that includes the other Party's end user information to Third Parties without the other Party's written approval. The other Party will inform the Releasing Party if it desires to have the Releasing Party provide the other Party's DA Listing Information to the Third Party, in which case, the Releasing Party shall provide the other Party's DA Listing Information at the same time as the Releasing Party provides the Releasing Party's DA Listing Information to the Third Party. The rate to be paid by the Releasing Party to the other Party shall be confidential information pursuant to Article III no more than the direct costs of this Agreement and NEN will use compiling such information. The other Party shall be responsible for billing the listings only for its DA services to its end-users. NEN is not authorized to release GTE’s DA listing information to any third party or to provide DA to any other party using GTE DA listing information, including NEN’s affiliates, subsidiaries or partners, except with the expressed written permission of GTE. Implementation of customized routing, pursuant to Article VII, Section 11 is required for NEN QTC to provide DA Directory Assistance Service for GTE Resold and Unbundled Port services. 7.1 DA 8.1 Directory Assistance Listing Information includes is the listed names, addresses and telephone numbers of GTE and authorized LEC CLEC subscribers, except as otherwise provided herein. Excluded are listings for restricted LEC lines and non-published listingsCLEC lines. GTE DA directory assistance listing information includes 800/888 listings, non-non- listed numbers and foreign listings within the GTE franchise. GTE will also provide non-published listings subject to the following limitations: 8.1.1 GTE will provide the name and address for non-published listings along with a non- published indicator. GTE may also provide the full ten (10) digit telephone number on an interim basis only, until GTE, in its sole discretion, modifies its systems to preclude the delivery of the non-published telephone number. Following such modification, QTC agrees that the non-published telephone numbers will no longer be available. 7.2 8.1.2 QTC agrees to defend, hold harmless and indemnify GTE against any claims, damages or liabilities arising out of any complaint, suit or other action brought by third parties relating to the release by QTC of any non-published customer names, addresses or numbers. 8.2 GTE shall provide to NENQTC, at NEN’s QTC's request, DA directory assistance listing information within sixty (60) Business Days after an order is received for that specific state. The DA listing information will be provided in GTE format via magnetic tape or National Data Mover (NDM) as specified by NENQTC. Updates to the DA listing information shall be provided on a daily basis through the same means used to transmit the initial load. The other Party will inform the Releasing Party if it desires to have the Releasing Party provide the other Party's DA Listing Information to the third party, in which request GTE’s DA listing informationcase, unless NEN provides GTE written notice within sixty (60) Business Days after the effective date of this Agreement that its Releasing Party shall provide the other Party's DA listing information is restricted and should not at the same time as the Releasing Party provides the Releasing Party's DA Listing Information to the third party. The DA listing information Such listings will be provided in GTE format via magnetic tape or National Data Mover (NDM) Confidential Information under this Agreement and RECONEX will use the listings only for its directory assistance services to its end users. If RECONEX uses a Third Party directory assistance service to its end users, RECONEX will ensure that such Third Party likewise treats the listings as specified by NENConfidential Information under this Agreement, and uses them only for such directory assistance.
