Common use of Disclosure Requirements Clause in Contracts

Disclosure Requirements. Consistent with FTA policies, the Contractor must disclose to STA, and each of its subcontractors must disclose to the Contractor: Any instances of organizational conflict of interest, or Violations of federal criminal law, involving fraud, bribery or gratuity violations potentially affecting the federal award. Failure to Disclose. Failure to make required disclosures can result in remedies for noncompliance, including debarment or suspension. Veterans Preference. As provided by 49 USC § 5325(k), to the extent practicable, the Contractor agrees and assures that each of its subcontractors: Will give a hiring preference to veterans, as defined in 5 USC § 2108, who have the skills and abilities required to perform construction work required under a third-party contract in connection with a capital project supported with federal assistance appropriated or made available for 49 USC chapter 53; and Will not require an employer to give a preference to any veteran over any equally qualified applicant who is a member of any racial or ethnic minority, female, an individual with a disability, or a former employee.
