Common use of Discretion to Encumber Clause in Contracts

Discretion to Encumber. This Agreement shall not prevent or limit Owner, in any manner, at Owner's sole discretion, from encumbering some or all of the Property and/or any improvement on the Property by any mortgage, deed of trust, or other security device securing financing related to the Property or the Project.

Discretion to Encumber. This Agreement shall not prevent or limit Owner, Owner in any manner, manner at Owner's ’s sole discretion, from encumbering some the Property, or all any portion of the Property and/or Property, or any improvement on the Property Property, by any mortgage, deed of trust, or other security device securing financing related with respect to the Property or the Projectits improvement.

Discretion to Encumber. This Agreement shall not prevent or limit Owner, in any manner, at Owner's ’s sole discretion, from encumbering some or all of the Property and/or or any improvement on the Property by any mortgage, deed of trust, or other security device securing to secure financing related to the Property or the Project. Notwithstanding the foregoing, any project or property shall be free and clear of all liens and encumbrances other than those previously approved in writing by the City prior to transfer to the City.
