Common use of Discretionary Nature Clause in Contracts

Discretionary Nature. Each Swing Line Loan by the Swing Line Lender to any Borrower shall be in the Swing Line Lender’s sole discretion, and the Swing Line Lender need not show that an adverse change has occurred in any such Borrower’s condition, financial or otherwise, or that any of the conditions of this Section 2.2 or Article 4 or otherwise of this Agreement have not been met, in order to refuse to make any requested Swing Line Loan.
