Displaying Promotional Materials. The Merchant agrees to obtain approval from The Acquiring Bank in writing, prior to the publication or advertising of any promotional material containing the SPAN Xxxx. The Merchant further agrees to display the SPAN Xxxx on the SPAN-POS Terminals and at visible locations within The Merchant’s outlet. Additionally, The Merchant is required to ensure that the SPAN- POS Terminals are visible and easily located by the Cardholder. The Merchant’s right to use or display the SPAN Xxxx and name shall continue only so long as this Agreement remains in effect, and is not suspended or terminated until The Merchant is notified by The Acquiring Bank to cease such usage or display, whichever is the earliest. Additionally, The Merchant must neither advertise nor display the SPAN Xxxx in a false, deceptive or misleading manner, nor must it display or advertise any negative comments relating to the SPAN Xxxx or services provided.
