Common use of Disqualifications Clause in Contracts

Disqualifications. i. Bidders who had been black listed/debarred by FCI or any Govt. Department/Public sector, including GST authorities undertaking shall be ineligible during the currency of such bar/black listing. ii. Any bidder whose contracts with the FCI or any Govt./Public Sector Undertaking had been terminated before the expiry of the contract period at any point of time during last five years, will be ineligible. iii. Bidders whose Xxxxxxx Money Deposit and/or Security Deposit has been forfeited by FCI or any Govt./Public Sector Undertaking during the last five years, shall be ineligible. iv. If the proprietor/any of the partners of the bidder firm/any of the Directors of the bidder Company have been, at any time convicted by a court for any offence and sentenced to imprisonment for a period of three years or more, such Bidder shall be ineligible. v. A Hindu Undivided Family shall not be entitled to apply for Tender in the capacity of HUF. Any bids submitted in the capacity of Hindu Undivided Family (either as a Proprietor or Partner of a Firm) shall be summarily rejected. vi. Any Firm/Company if blacklisted/debarred by Govt. of India to undertake any similar transportation activities at any time during last five years.

If the proprietor/Bidder Firm, its proprietor / any of the partners of the bidder firm/partners/ any of the Directors of the bidder Company have been, at any time convicted by a court for any offence and sentenced to imprisonment for a period of three years or more, such Bidder shall be ineligible. v. iv. A Hindu Undivided Family shall not be entitled to apply for Tender tender in the capacity of HUF. Any bids submitted in the capacity of Hindu Undivided Family (either as a Proprietor proprietor or Partner partner of a Firmfirm) shall be summarily rejected. vi. v. Any Firm/Company firm if blacklisted/debarred by Govt. of Bangladesh or Govt. of India to undertake any similar transportation activities in Indo-Bangladesh IWT Protocol route at any time during last five years.

If the proprietor/any of the partners of the bidder firm/any of the Directors of the bidder Company have been, at any time convicted by a court for any offence and sentenced to imprisonment for a period of three years or more, such Bidder shall be ineligible. v. A Hindu Undivided Family shall not be entitled to apply for Tender in the capacity of HUF.
