DISRUPTIONS. 1.3.1 The Licensee acknowledges that from time to time, as a result of Software failure or acts of God, the services provided under this Agreement by UNITED can be temporarily disrupted. The Licensee acknowledges and agrees that neither UNITED nor any of its members, shareholders, directors, officers, employees or representatives will be liable to the Licensee or any of the Licensee's customers for any special, indirect, consequential, 23 punitive or exemplary damages, or damages for loss of profits or savings, in connection with these temporary disruptions.
1.3.2 The Licensee acknowledges that UNITED's ability to perform its obligations under this Agreement may be subject to government licensing in whatever jurisdiction Licensee may choose to operate. UNITED shall not be held liable for any damages of any kind whatsoever that may result from changes in government legislation or policy.
DISRUPTIONS. Except to the extent disclosed on Part 2.24 to the Company Disclosure Letter, since December 31, 2000 there has not occurred any material disruptions to network operations, or any material delays in planned facility or network build out or construction activities, or any material performance failures by the Company, or other material service disruptions, that have resulted in material customer complaints or material breaches of customer installation commitments, in each case with respect to the Company, which individually or in the aggregate, have a Material Adverse Effect on the Company. Except as set forth in Part 2.24 of the Company Disclosure Letter, the Company has in place a formal disaster recovery plan reasonably calculated to ensure prompt recovery from material disruptions to Company's network operations without incurring liabilities to customers.

The Licensee acknowledges that from time to time, as a result of Hardware failure, supplier failures, or acts of god, the services provided under this Agreement by Webcast can be temporarily disrupted. The Licensee acknowledges and agrees that neither Webcast nor any of its members, shareholders, directors, officers, employees or representatives will be liable to the Licensee or any of the Licensees customers for any specific, indirect, consequential, punitive or exemplary damages, or damages for loss of profits or savings, in connection with these temporary disruptions. For the purpose of this section, if the services provided under this Agreement by Webcast are temporarily disrupted for a period of seven days or more, the minimum monthly fees as calculated in section l.7.2 shall be reduced on a pro rata basis.

Licensee acknowledges and agrees that neither Licensor, its agents nor any Licensor employees will be liable to Licensee or any of Licensee's customers for any special, indirect, consequential, punitive or exemplary damages, or damages for loss of profits or savings, in connection with these temporary disruptions.
DISRUPTIONS. You are solely responsible for protecting against computer viruses, bugs, power disruptions, communication line disruptions, internet access failures, internet content failures, date-related problems, and attacks by hackers and other unauthorized intruders. Upon our request, you must obtain and maintain cyber insurance and business interruption insurance for technology disruptions.
