Common use of Documents and Witness Lists Clause in Contracts

Documents and Witness Lists. Either party may request from the other the production, review, and right to copy nonconfidential documents relevant to the grievance. If the other party disputes the request, the arbitrators shall determine the issues. The parties shall also, at least two (2) days prior to the first hearing date, exchange lists of intended witnesses. This does not preclude either party from introducing new witness(es) whose testimony includes new evidence that the arbitrator agrees could not be reasonably foreseen at the time of the development of the witness list.
