Common use of Drainage Matters Clause in Contracts

Drainage Matters. Soil and drainage conditions may vary throughout the Project, and portions of the Project, including the Ag Lot, may be susceptible to flooding and may experience high levels of water run-off from the neighboring properties. Licensor does not make any representations or warranties, express or implied, with respect to soil compaction, soil condition, or drainage within the Project or the Ag Lot, or the need for, or the extent of any required, grading, fill, and/or drainage improvements in connection with Licensee’s proposed use of the Ag Lot. Licensor shall not be liable to any Licensee for any loss, damage or other adverse effects cause by flooding or drainage of water run-off.
