Common use of During Term of Employment Clause in Contracts

During Term of Employment. During Employee's term of employment pursuant to this Agreement, Employee will not compete with the Company or its affiliates, directly or indirectly, either for himself or as a member of a partnership or a limited liability company or as a stockholder (except as a stockholder of less than one percent (1 %) of the issued and outstanding stock of a publicly-held company whose gross revenues exceed $100 million), investor, owner, officer or director of a company or other entity, or as an employee, agent, trustee, manager, associate or consultant of any person, partnership, corporation or other entity, in any business in competition with that carried on by the Company or any of its affiliates. As of the date hereof, the Company anticipates that it will engage principally in the business of providing information technology services to a variety of industries, but the provisions of this Section 8.(a) shall apply to any business in which the Company or its affiliates are engaged during the term of Employee's employment.
