Dxxxx Xxxments. Subject to the provisions of Section 4.8, if the Commercial Operations Date occurs: (i) more than fifteen (15) but less than seventy-six (76) days after the In-Service Date, Seller shall pay Buyer eighteen thousand dollars ($18,000) per day (not including the first fifteen (15) days after to the In-Service Date); or (ii) more than seventy-five (75) days after the Commercial Operations Date, one million eighty thousand dollars ($1,080,000) plus thirty-six thousand dollars ($36,000) per day for all such days that are more than seventy-five (75) days after the In-Service Date.
