Service Date a. Services shall commence on or after July 1, 2016 and shall end upon the end of the duration date
b. The County Board of Supervisors specifically acknowledges that in anticipation of execution of this contract, services within the scope of this contract may have been provided in reliance on assurances that this contract would be executed by the parties on the effective date. The services may have been rendered from July 1, 2016 to the date the Parties are executing this contract and which were intended in the best interest of the public health and welfare. The Board of Supervisors expressly authorizes the retroactive effective date under this contract to July 1, 2016. The Board of Supervisors also expressly authorizes payment for those services accepted by the County at the same rates and under the same terms and conditions as stated in this contract, even though this contract is being signed after July 1, 2016.
c. If any services from July 1, 2016 until the effective date have been paid by a purchase order via the County Purchasing Agent, that amount shall be deducted from the maximum allowed expenditure under Paragraph 1.a of Exhibit B of this contract.
Service Date. (a) The Supplier will advise the Client of the date on which the Supplier will seek to commence provision of the Services (the “Estimated Service Date”). Except as expressly provided in the Additional Terms Schedule, the Supplier shall not be liable for any damages whatsoever resulting from any failure to meet the Estimated Service Date.
(b) The Services and the invoicing of monthly recurring Charges will commence on the date that the Supplier actually makes the Services available, whether or not the Client makes use of such Services (the “Service Date”).
(c) Unless otherwise agreed upon in writing between the parties, or as otherwise provided in this Agreement, neither party may terminate this Agreement during the Initial Term.
Service Date. Employee service date is the first day of the pay period in which the employee begins work.
Service Date. The service date shall be the date the Customer connects to EH!tel services, or within 10 days of the date EH!tel has expired all attempts to schedule the installation of services, which ever comes first. (hereinafter called the “Service Date”).
Service Date. At such time as TCG completes installation or connection of the necessary fiber optic facilities and/or equipment to provide the Services, TCG shall conduct appropriate tests thereon. Upon successful completion of such tests TCG shall notify Reseller that such Services are available for use. TCG shall use reasonable efforts, subject to the other provisions hereof, to make the Services available by the estimated Service Date specified in the Service Supplement. TCG shall not be liable for any damages whatsoever resulting from delays in meeting any service dates due to delays resulting from normal construction procedures. Such delays shall include, but not be limited to, delays in obtaining necessary regulatory approvals for construction, delays in obtaining right-of-way approvals and delays in actual construction work. In the event there is a Reseller or Customer caused delay, and such delay continues for thirty (30) days after the estimated service date for any Resale Services, TCG may commence billing Reseller for the Resale Services effective on such a date. TCG shall commence billing Reseller for the Resale Services effective on the Service Date and, if applicable, for costs of IntraLATA or InterLATA calls incurred by the Reseller subsequent to TCG notifying Reseller that such Services are available for use. For any Resale Services ordered by Reseller and provided by TCG, Reseller reserves the right to delay the Service Date, and provide TCG as much advance notice as reasonably possible, provided Reseller shall be liable to TCG for any applicable delay or change order charge assessed by the provider of the Resale Services.
Service Date. Supplier shall use commercially reasonable efforts to provide each Service ordered and accepted pursuant to a Firm Order Confirmation by no later than the date specified in or accepted by such Firm Order Confirmation. Supplier's standard provisioning intervals for Services are listed in the applicable Service schedule, and the scheduled Service Date specified in a Firm Order Confirmation shall in no event be prior to expiration of the applicable interval. Customer may request that such Service be made available prior to such specified date, in which event Supplier shall use reasonable efforts to make such Service available by the date requested, but Supplier shall not be responsible or in any way penalized or liable for its failure to do so. Customer may request that such Service be delayed by up to thirty (30) days after such specified date, as set forth in Attachment 2 under the caption "Billing and Payment." If Supplier fails to provide the Service by the date specified pursuant to the applicable Firm Order Confirmation and such failure is not due to (i) any FORCE MAJEURE Event, (ii) any failure of Customer to comply with the terms of this Agreement, or (iii) any fault or negligent act or omission of Customer, any End User or any other party, then Customer shall not be required to pay the Non-Recurring Charge with respect to such Service. Customer's relief from paying such Non-Recurring Charge shall be the sole and exclusive remedy of Customer in the event of such failure by Supplier to provide such Service by such date, and under no circumstances shall such failure be deemed a default under this Agreement.
Service Date. City and County acknowledge that the services provided under this contract are a continuation of those established during the preceding contract term and that these services may have been provided uninterruptedly between July 1, 2019 and the date of execution by the County in order to ensure the interest of public service.
a) Both City and County expressly and retroactively authorize the provision of those services.
b) For the purposes of billing and determination of the First Year Service Fee as provided in Exhibit B, the first year of service will be presumed to have begun on July 1, 2019.
Service Date. In-Service Date as used herein shall mean the earlier of: (i) actual use of the Services; (ii) the date the Service is installed and is running in test mode in accordance with the requirements of this Agreement, with no trouble tickets established by Customer; or (iii) seven (7) days after delivery of circuits, facilities and/or Service to Customer’s premises in the event Customer fails to test such circuit, facilities and/or Service. Point of Demarcation. The interface between Conterra and Customer, whether at Customer’s point of presence or other Customer-designated terminal equipment. Such point will be identified in the Order and designate the point at which Conterra’s responsibilities begin. Point of Presence (“POP”). A specific location where Customer originates and/or terminates its Service. Service or Services. Conterra provided telecommunications and related services. Service Outage. A disruption or degradation of Service and/or Services that fails to meet the performance specifications set forth in the Agreement or applicable service level agreement. Service Commitment Period or Term. The committed service term set forth in an Order.
Service Date. Total length of service with the Department calculated from the latest employment date with the Department after adding four years for a Performance Evaluation score of “Exceptional” and two years for a Performance Evaluation score of “Successful”. The Performance Evaluation score must be on record for at least 90 days.
X. Xxxxxxxxx will only be used when absolutely necessary as a mechanism to reduce costs for deletion of positions, shortage of work or funds, or other reasons that do not reflect discredit on the services of the employees.
B. Budget activities, as defined by the DFA, will be used for purposes of furlough. C. Whenever possible, every individual within an organizational unit will be furloughed an equal number of hours in order to minimize the impact to each individual.
D. In organizational units where there are custody personnel, all individuals will be divided into two groups: custody and non-custody. Furloughs will take place within these twocategories.
