Common use of Each Phase Independent Clause in Contracts

Each Phase Independent. It is the Parties’ intention to proceed with the Project and, in good faith, take all actions reasonably necessary to complete each of the three Phases of this Contract. However, the Parties understand and agree that Owner may, for cause or for convenience, terminate this Contract or any Phase hereof, should Owner, in its sole discretion determine it is in the public interest to do so.
