Early Resolution and Mediation Option. The Parties shall attempt to resolve any dispute arising under or with respect to this Agreement within ten (10) days after the exchange of the written Statements of Position. The Parties may elect to attempt to resolve the dispute through the use of a neutral third-party mediator if all Parties involved in the dispute agree to such mediation and the selection of the mediator within thirty (30) days after the exchange of written Statements of Position. Each Party shall bear its own costs and one-half of any third party costs, including those of the mediator, in such mediation. The period of mediation shall not exceed thirty (30) days from the date that the mediator is selected, unless the Parties involved in the dispute otherwise mutually agree in writing.
