Common use of Economic or Technical Failure by Operator Clause in Contracts

Economic or Technical Failure by Operator. Subsequent to the commencement of construction and/or operation of the Improvements, in the event Operator determines that the Site is not appropriate for economic or technological reasons, Operator may terminate this Agreement by giving INDOT one hundred eighty (180) days prior written notice.
