Effect of Modification of Agreement by Court. If any Class Members apply to the Court for a modification of, addition to, or alteration of any material term or condition of this Agreement, and if the Court on such request or of its own accord does modify, add to, or alter any of the material terms or conditions of this Agreement, this Agreement shall become voidable at the option of either of the Parties and of no further effect upon the filing with the Court of Notice of Withdrawal from settlement by Class Counsel or the Province’s counsel within five (5) business days of receipt of any order or final statement of the Court modifying, adding to, or altering any of the material terms or conditions of this Agreement.
