Effect of Opt-Outs on the Settlement Agreement. This Settlement Agreement shall be voidable at the election of Plaintiff or HMI if the number of persons on the Opt-Out List exceeds 5% of the number of persons on the Class List. The party exercising this option must serve a written notice of termination on Class Counsel and Defendant’s Counsel within seven (7) days after the Settlement Administrator sends the Opt-Out List, and thereafter file a written notice of termination with the Court. The Parties agree that the failure to timely provide the written notice of the exercise of this option on the opposing party’s counsel constitutes a waiver of the right to void the Settlement Agreement.
