Effect of TxDOT or Maintenance Contractor Activities on Warranties. Developer acknowledges and agrees that TxDOT and the Maintenance Contractor and their respective agents may perform certain maintenance work during the period in which the Warranties are in effect and agrees that the Warranties shall apply notwithstanding such activities; provided however that Developer does not hereby waive any rights, claims or remedies to which it may be entitiled as a result of such activities.
