Common use of EFFECT OF WAIVERS Clause in Contracts

EFFECT OF WAIVERS. Either party's waiver of any breach or failure to enforce any of the terms, covenants, conditions or other provisions of this EPC Contract at any time shall not in any way affect, limit, modify or waive that party's right thereafter to enforce or compel strict compliance with every term, covenant, condition or other provision hereof, any course of dealing or custom of the trade notwithstanding. The waiver by Supplier or Owner of any breach or failure to enforce any of the terms, covenants, conditions or other provisions of the Supply Contract at any time shall not in any way affect, limit, modify or waive Owner's or Contractor's right thereafter to enforce or compel strict compliance with every term, covenant, condition or other provision of this EPC Contract, any course of dealing or custom of the trade notwithstanding.

The waiver by Supplier Customer or Owner Contractor of any breach or failure to enforce any of the terms, covenants, conditions or other provisions of the Supply Prime Contract at any time shall not in any way affect, limit, modify or waive Owner's or Contractor's ’s right thereafter to enforce or compel strict compliance with every term, covenant, condition or other provision of this EPC ContractSubcontract Agreement, any course of dealing or custom of the trade notwithstanding.
