Effective Date and Renewal. (a) This agreement shall become effective when signed by the Assistant Administrator for Fisheries of NMFS and the Director of FWCC, and may be renewed in the following manner: Not later than June 30 each year FWCC shall submit to the Assistant Administrator for Fisheries of NMFS the following: (1) the current list of the state-listed resident endangered and threatened fish and wildlife within the jurisdiction of NMFS and a description of all changes to such list or the listing process since the date of the previous submission of the list to NMFS; (2) a certification of any amendments in FWCC’s legal or regulatory authority that affect the conservation of endangered and threatened fish and wildlife that were made since the date of the previous submission of the program to NMFS; (3) a list of all changes or proposed changes in the endangered and threatened species conservation programs since the date of the previous submission of the program to NMFS; and (4) any additional information requested by the Assistant Administrator for Fisheries of NMFS that pertains to FWCC’s program for the conservation of endangered and threatened fish and wildlife; (b) The Southeast Regional Administrator will, on or before October 1 of each year, notify FWCC in writing whether the cooperative agreement is renewed effective October 1 of that year, or that the state’s program or authorities are no longer in compliance with the criteria of Section 6(c) of the Act, and unless appropriate changes are made by June 30 of the following year, this agreement shall be terminated. If FWCC, after satisfying the renewal provisions of the immediately preceding paragraph, has not been notified concerning the renewal of this agreement by October 1 of each year, then the agreement shall continue in force and effect as if it had been renewed.

If FWCCADF&G, after satisfying the renewal provisions of the immediately preceding paragraph, has not been notified concerning the renewal of this agreement by October 1 of each year, then year the agreement shall continue in force and effect as if it had been renewed.

Not later than June 30 August 30th of each year FWCC the Commission shall submit to FWS the Assistant Administrator for Fisheries of NMFS the followingfollowing items: (1) additions and deletions to the current list of the state-Federal and State listed resident endangered and threatened fish and or wildlife within which are resident in the jurisdiction of NMFS and a description of all changes to such list or the listing process since the date of the previous submission of the list to NMFSState; (2) a certification memorandum of law analyzing any amendments changes in FWCCthe Commission’s legal or statutory and regulatory authority that affect the conservation of for endangered and threatened fish and or wildlife that which were made since the date of the previous program submission and also analyzing the application of State law to any resident fish or wildlife which have been added to the Federal endangered or threatened fish or wildlife which are being proposed or which have occurred since the date of the previous program to NMFSsubmission; (3) a list of all changes or proposed any substantial changes in the State’s conservation program for resident endangered and or threatened species conservation programs fish or wildlife which are being proposed or which have occurred since the date of the previous submission program submission; (4) a detailed description of the program number of specimens of each species of Federally listed endangered or threatened fish or wildlife taken pursuant to NMFSsubsections 2(b), (c), and (e) of this Cooperative Agreement, the conservation purposes for which they were taken and any mortalities or permanent disabling injuries resulting from the taking, as well as the number of each species permitted for incidental take pursuant to subsection 2(d); and (45) any additional information requested by copies of reports the Assistant Administrator Commission has prepared since the previous program submission which discuss its conservation program accomplishment for Fisheries of NMFS that pertains to FWCC’s program for the conservation of listed endangered and threatened fish and wildlife;.
(b) b. The Southeast Regional Administrator FWS will, on or before October 1 1st of each year, notify FWCC the Commission in writing whether either that the cooperative agreement Cooperative Agreement is renewed effective October 1 of that year, or that the stateCommission’s endangered or threatened fish or wildlife conservation program or authorities are no longer not in compliance with the criteria of Section 6(c) of the ActAct and, and unless appropriate changes are made by June 30 30th of the following year, this agreement Cooperative Agreement shall be terminated. If FWCC, after satisfying the renewal provisions of the immediately preceding paragraph, Commission has not been notified concerning the renewal of this agreement received notification by October 1 of each year1st that the Cooperative Agreement has been renewed or that the conservation program or authorities are not in compliance with the above referenced criteria, then the agreement Cooperative Agreement shall continue in force and effect as if it had has been renewed.
c. For purposes of the Section, the phrase “previous program submission” means either program submission of (1) the original Cooperative Agreement or (2) the most recent renewal application for the Cooperative Agreement, whichever is later in time.
