Common use of ELECTRICAL INSTALLATION CERTIFICATE OF COMPLIANCE Clause in Contracts

ELECTRICAL INSTALLATION CERTIFICATE OF COMPLIANCE. 24.1 The Seller hereby undertakes to furnish the nominated attorneys, prior to transfer to the Purchaser, with a certificate of compliance in respect of the property, in terms of the Electrical Installation Regulations of 2009 under the Occupational Health and Safety Act (Act No. 85 of 1993, as amended), issued by an electrical contractor who is registered in terms of the Regulations. All costs incurred in obtaining such a certificate, including costs of any repairs or replacements required in order for the certificate to be issued, shall be borne by the Seller upon the Seller furnishing the transfer attorneys with such certificate, the Purchaser shall have no claim whatsoever against the Seller in respect of electrical installations and no further liability in this regard shall rest upon the Seller. 24.2 The Seller warrants that, as at date of transfer, there will have been no addition or alteration to the electrical installations existing on the property subsequent to the issue of such certificate. In the event that there has been any addition and/or alteration, the Seller shall be obliged to obtain a certificate of compliance for at least the addition or alteration. 24.3 An electrical certificate of compliance issued not more 2 (two) years prior to the date of this Agreement of Sale shall be valid and effective for the purposes of this clause 25.

ELECTRICAL INSTALLATION CERTIFICATE OF COMPLIANCE. 24.1 22.1 The Seller PURCHASER hereby undertakes to furnish the nominated SELLER’s attorneys, prior to transfer to the PurchaserPURCHASER, with a certificate of compliance in respect of the propertyPROPERTY, in terms of the Electrical Installation Regulations of 2009 under the Occupational Health and Safety Act (Act No. 85 of 1993, as amended), issued by an electrical contractor who is registered in terms of the Regulations. All costs incurred in obtaining such a certificate, including costs of any repairs or replacements required in order for the certificate to be issuedsuch, shall be borne by the Seller upon PURCHASER. 22.1.1 Upon the Seller PURCHASER furnishing the transfer SELLER’s attorneys with such certificate, the Purchaser PURCHASER shall have no claim whatsoever against the Seller SELLER in respect of electrical installations and no further liability in this regard shall rest upon the SellerSELLER. 24.2 22.2 The Seller SELLER warrants that, as at date of occupation or transfer, there will have been no addition or alteration to the electrical installations existing on the property PROPERTY subsequent to the issue of such certificate. In the event that there has been any addition and/or alteration, the Seller SELLER shall be obliged to obtain a certificate Certificate of compliance Compliance for at least the addition or alteration. 24.3 An electrical 22.3 In the event of an electric fence certificate on the property, the PURCHASER shall, in compliance with Section 12(2) of the Electrical Machinery Regulations 2011, an additional Compliance Certificate will be issued by an accredited authority confirming compliance issued not more 2 (two) years prior to of the date of this Agreement of Sale shall be valid and effective for the purposes of this clause 25electric fence installation with SANS 00000-0-00.

The certificate shall be issued by an electrical contractor who is registered in terms of the Regulations. All The costs incurred in associated with obtaining such a certificate, including the costs of any repairs or replacements required in order for the certificate to be issued, shall be borne and paid for by the Seller upon seller. Once the Seller furnishing seller has furnished the transfer attorneys seller's Attorneys with such certificate, the Purchaser purchaser shall have no claim whatsoever against the Seller seller in respect of the electrical installations installation and the seller shall have no further liability in this regard shall rest upon the Sellerregard. 24.2 18.6.2 The Seller warrants seller confirms that, as at date of transfer, transfer there will have been no addition or alteration to the electrical installations existing on the property subsequent to the issue of such certificate. In the event that there has been any addition and/or alteration, the Seller seller shall be obliged to obtain a certificate Certificate of compliance Compliance for at least the addition or alteration. 24.3 18.6.3 An electrical certificate Electrical Certificate of compliance Compliance issued not more 2 (two) years prior to the date of this Agreement of Sale shall be valid and effective for the purposes of this clause 2518.

ELECTRICAL INSTALLATION CERTIFICATE OF COMPLIANCE. 24.1 27.1. The Seller hereby PURCHASER agrees and undertakes to furnish take steps sufficient to ensure, as far as is reasonably practicable, that the nominated attorneysPROPERTY will comply with all prescribed requirements, prior to transfer to including the Purchaser, with issue of a certificate Certificate of compliance Compliance in respect of the property, thereof as required in terms of clause 7 of the Electrical Installation Regulations of 2009 under the Occupational Health and Safety Act (Act No. 85 of 1993, as amended), issued by and in the event of an electrical contractor who is registered Electric Fence System installed on the PROPERTY as referred to in terms Regulation 12 (4) of the Electrical Machinery Regulations, 2011, a Certificate of safety thereof, and that the PROPERTY will be safe and without risks to health. 27.1.1. The PURCHASER hereby relieves the SELLER from the duty imposed upon him by the provisions of section 10 of Act 85 of 1993. All costs incurred in obtaining such a certificateCertificates of Compliance, including costs of any repairs or replacements required in order for the certificate certificates to be issued, shall be borne by the Seller upon the Seller furnishing the transfer attorneys with such certificate, the Purchaser shall have no claim whatsoever against the Seller in respect of electrical installations and no further liability in this regard shall rest upon the SellerPURCHASER. 24.2 The Seller warrants that, as at date of transfer, 27.2. Should there will have been no any addition or alteration to the electrical installations existing on the property PROPERTY subsequent to the issue of such certificate. In the event that there has been any addition and/or alterationcertificates, the Seller PURCHASER shall be obliged to obtain a certificate Certificate of compliance Compliance for at least the such addition or alteration. 24.3 27.3. An electrical certificate Electrical Certificate of compliance Compliance issued not more 2 (two) years prior to the date of this Agreement of Sale shall be valid and effective for the purposes of this clause 2527.
