Electrical Warranty. If, within ten (10) years from the date of delivery of the Products in accordance with each Purchase Order hereof, any Product has a power output below 90% (ninety percent) or within twenty-five (25) years, a power output below 80% (eighty percent) of the minimum power output as specified in the Product Specifications and measured by Supplier* prior to delivery, then, provided that such loss in power is determined by Supplier at its sole discretion to be solely due to materials or workmanship, Supplier shall replace such loss in power by either providing additional Products to make up the total wattage loss, at the cost pro-rated for the time in service of the faulty Product, or by repairing or replacing the Product, at the option of Supplier. The warranty for such repaired, replaced or additional Products will extend to the remainder of the original warranty period only. *The Products’ power output will be measured by Supplier using standard testing conditions (25°C (twenty five degrees Celsius) cell temperature, irradiation 1.000 W/m2 (thousand Watt per square meter) and air mass 1.5 (one point five)).

  • General Warranty Vendor warrants that the Services will be performed and delivered in a professional, first-class manner in accordance with this Agreement and the standards prevailing in the industry. To this end, Vendor will undertake the following actions without additional consideration during the term of this Agreement and for one (1) year thereafter: (a) promptly make necessary revisions or corrections to resolve any errors and omissions on the part of Vendor; and, (b) confer with Citizens as Citizens deems appropriate for the purpose of interpreting any of the Services or information furnished. Acceptance of or payment for the Services by Citizens shall not relieve Vendor of these responsibilities. The warranties and covenants in this Section will extend to and bind Vendor’s subcontractors, if any.

  • Special Warranty When its Underlying Agreement involves public transportation operations and is supported with federal assistance appropriated or made available for 49 U.S.C. § 5311, U.S. DOL will provide a Special Warranty for its Award, including its Award of federal assistance under the Tribal Transit Program. The Recipient agrees that its U.S. DOL Special Warranty is a condition of the Underlying Agreement and the Recipient must comply with its terms and conditions.

  • Electrical Items All electrical items purchased under this Grant Agreement/Contract or used in the performance of approved and eligible grant-funded activities must meet all applicable Occupational Safety and Health Administration (OSHA) standards and regulations, and bear the appropriate listing from Underwriters Laboratory (UL), Factory Mutual Resource Corporation (FMRC), or National Electrical Manufacturers Association (NEMA).

  • Electrical Equipment Residents must use only CSA, UL-approved or Canadian-certified electrical equipment; the rated wattage of light fixtures must never be exceeded; and only replacement bulbs supplied by Waterloo maintenance staff may be used. Do not leave any unattended electrical equipment turned on (i.e. hair straighteners, lights etc.)

  • Mutual Warranty Each party represents and warrants that it has the legal power and authority to enter into this Agreement.
