Common use of Eligibility for Leaves of Absence for a Newborn or Newly Placed Child and for the Care of a Family Member Clause in Contracts

Eligibility for Leaves of Absence for a Newborn or Newly Placed Child and for the Care of a Family Member. In order to qualify for a leave for a newborn or newly placed child or leave for the care of a family member the employee must meet all of the following conditions: (i) The employee must have worked for the Employer at least twelve (12) months or fifty-two (52) weeks. The twelve (12) months, or fifty-two (52) weeks need not have been consecutive. For eligibility purposes, an employee will be considered to have been employed for an entire week even if the employee was on the payroll for only part of a week or if the employee is on leave during the week. (ii) Employees who have been employed by the Employer more than one (1) year must have worked at least 1250 hours during the twelve (12) month period immediately before the date when the leave would begin.
