System Agency Right to Use Contractor agrees that System Agency has the right to use, produce, and distribute copies of and to disclose to System Agency employees, agents, and contractors and other governmental entities all or part of this Contract or any related Solicitation Response as System Agency deems necessary to complete the procurement process or comply with state or federal laws.
Permission to Use References in this Agreement to permission to use the Route shall, except where the contrary is indicated, be construed to mean permission:-
Freedom to Use Ideas Subject to Section 9 and Client’s rights in Client Information and notwithstanding anything to the contrary contained in this Agreement or an Order Form, the ideas, methods, concepts, know-how, structures, techniques, inventions, developments, processes, discoveries, improvements and other information and materials developed in and during the course of any Order Form may be used by Red Hat, without an obligation to account, in any way Red Hat deems appropriate, including by or for itself or its clients or customers.
Notice to U.S. Government End Users The Licensed Software and Documentation are deemed to be “Commercial Items,” as defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7207, as applicable. Consistent with such sections, the Licensed Software and Documentation are licensed to U.S. Government end users (i) only as Commercial Items, and (ii) with only those rights as are granted pursuant to this License Agreement. Manufacturer is Micro Focus (US), Inc., 000 Xxxx Xxxx Xxxx., Xxxxx 000, Xxxxxxxxx, XX 00000 as or on behalf of Licensor.
Right to Use City shall not be limited in any way in its use or reuse of the Documents and Data or any part of them at any time for purposes of this Project or another project, provided that any such use not within the purposes intended by this Agreement or on a project other than this Project without employing the services of Consultant shall be at City’s sole risk. If City uses or reuses the Documents & Data on any project other than this Project, it shall remove the Consultant’s seal from the Documents & Data and indemnify and hold harmless Consultant and its officers, directors, agents and employees from claims arising out of the negligent use or re-use of the Documents & Data on such other project. Consultant shall be responsible and liable for its Documents & Data, pursuant to the terms of this Agreement, only with respect to the condition of the Documents & Data at the time they are provided to the City upon completion, suspension, abandonment or termination. Consultant shall not be responsible or liable for any revisions to the Documents & Data made by any party other than Consultant, a party for whom the Consultant is legally responsible or liable, or anyone approved by the Consultant.
Verification of Use 20 a. Pursuant to Multnomah County policy, Management must 21 require the completion of a certification form by the employee’s health care provider 22 and any other verifications required for under the provisions of the FMLA, OFLA, or 23 their successors.
DESCRIPTION OF WEBSITE SERVICES OFFERED The Site is a website interface and companion mobile application which has the following description: A cloud based, website and mobile application interface for tracking events of participants in the USDA CACFP (Child and Adult Care Food Program) and/or SFSP (Summer Food Service Program) to be used by Day Care Homes and Sponsoring Organizations, Child Care Centers and Sponsoring Organizations, At-risk Afterschool Care Centers and Sponsoring Organizations, Adult Day Care Centers and Sponsoring Organizations and Emergency Shelters and Sponsoring Organizations. Any and all visitors to our site and users of the website applications and/or companion mobile application(s) shall be deemed as "users" of the herein contained Services provided for the purpose of this TOS. The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Genius Programs. At its discretion, Genius Programs may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated. Genius Programs does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user acknowledge, accept and agree that Genius Programs shall not be held liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products. License to Use You are authorized to use the Software on one (1) single computer only. You may not use the Software on any other machines other than the said single computer.
