Common use of Eligible Checks and Items Clause in Contracts

Eligible Checks and Items. You agree to scan and transmit only checks as that term is defined in the Federal Reserve Regulation CC ("Reg CC") and only those checks that are permissible under this Agreement or such other items as we, in our sole discretion, elect to include under the Service. You agree that the image of the check transmitted to us shall be deemed an "item" within the meaning of Article 4 of the applicable Uniform Commercial Code. You agree that you will not use the Service to scan and deposit any checks or other items as described below:
