Eligible Items. You agree to scan and deposit only "checks" as that term is defined in Federal Reserve Regulation CC, Availability of Funds and Collection of Checks ("Reg. CC"). When the image of the check transmitted to us is converted to an Image Replacement Document for subsequent presentment and collection, it shall thereafter be deemed an "item" within the meaning of Articles 3 and 4 of the Uniform Commercial Code. You agree that you will not scan and deposit any of the following types of checks or other items which shall be considered ineligible items: 1. Checks payable to any person or entity other than the person or entity that owns the account that the check is being deposited into. 2. Checks containing an alteration on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn. 3. Checks drawn on a financial institution located outside the United States. 6. Checks that are remotely created checks, as defined in Reg. CC. 7. Checks not payable in United States currency. 8. Check previously deposited by other means. 9. Checks that are payable to cash. 10. Checks on which the numerical and written amounts are different. 11. Checks dated more than 6 months prior to the date of deposit or postdated (dated for a future date). 12. Checks or items prohibited by the Bank’s current procedures relating to the Mobile Deposit Service or which are otherwise not acceptable under the terms of your Account Agreement. 13. Checks payable on sight or payable through Drafts, as defined in Reg. CC. 14. Checks with any endorsement on the back other than that specified in this agreement. 15. Checks that have previously been submitted through the Mobile Deposit Service or through a remote deposit capture service offered at any other financial institution.

Checks or items payable to any person or entity other than yourself or otherwise to the person or entity that owns owner of the account that the check item is being deposited into. 2. b. Checks or items that are payable jointly, unless deposited into a deposit account in the name of all payees. c. Checks or items containing an obvious alteration to any of the fields on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. 3. d. Checks payable jointlyor items that have not been previously endorsed by a bank and are either “substitute checks”, unless deposited into an account in the name of all payees. 4. Checks previously converted to a substitute check, (as defined in Reg. CCRegulation CC or other applicable federal law or regulation) or “image replacement documents” that purport to be substitute checks, without our prior written consent. 5. e. Checks or items drawn on a financial institution located outside the United States or territories of the United States. 6. f. Checks or items that are remotely created checks, as defined in Reg. Regulation CC, or are remotely created payment orders. 7. g. Checks or items not payable in United States currency. 8. Check previously deposited by other means. 9. h. Checks that are payable to cash. 10. Checks on which the numerical and written amounts are different. 11. Checks or items dated more than 6 months prior to the date of deposit or postdated (dated for a future date)deposit. 12. i. Checks or items prohibited by the Bank’s our current procedures relating to the Mobile Deposit Service or which are otherwise not acceptable under the terms of your Account Agreementaccount or are in violation of any law, rule or regulation. 13. j. Checks payable on sight or payable through Drafts, as defined in Reg. CC. 14. Checks with any endorsement on the back other than that specified in this agreement. 15. Checks that have items previously been submitted through the Mobile Deposit Service or through a remote deposit capture service offered by us or at any other financial institution. If you deposit a prohibited check, you agree to indemnify and reimburse the Bank for, and hold the Bank harmless from and against, any and all losses, costs and expenses (including reasonable attorney’s fees) that the Bank may incur associated with any warrant, indemnity or other claim related thereto. Furthermore, if, after first having obtained our written consent to do so, you provide us with an electronic representation of a substitute check for deposit into a deposit account instead of an original check, you agree to indemnify and reimburse us for, and hold the Bank harmless from and against, any and all losses, costs and expenses (including reasonable attorney’s fees) we incur because any such substitute check resulting from such electronic representation does not meet applicable substitute check standards and or causes duplicate payments.

CCCC or are “image replacement documents” that purport to be substitute checks. 5. j) Checks drawn on a financial institution located outside the United States. 6. The Bank may in its sole discretion, and without liability to you, refuse any check for any or no reason, or elect to take the check on a remote deposit capture service offered collection basis only. The Bank reserves the right to charge back to your account, at any other financial institution.time, for any item that Bank subsequently determines was an ineligible item. Bank is not liable for any loss, costs, or fees you may incur as a result of a chargeback of an ineligible item.
