The Emergency Maintenance Work clause defines the procedures and permissions for carrying out urgent repairs or maintenance that cannot be delayed. Typically, this clause allows a party—often a landlord or property manager—to enter the premises without prior notice to address situations that pose immediate risks to safety, property, or essential services, such as fixing a burst pipe or restoring power. Its core function is to ensure that critical issues are resolved promptly to prevent harm or further damage, balancing the need for swift action with the rights of occupants.
Emergency Maintenance Work. (a) If, as a result of an Emergency, the need arises for Unscheduled Maintenance Work, Project Co may perform such Unscheduled Maintenance Work, provided that Project Co shall notify the HRRH Representative as soon as possible (and in any event within 2 Business Days of the occurrence of the Emergency) of the reasons for and extent of the Unscheduled Maintenance Work.

(a) If, as a result of an Emergency, the need arises for Unscheduled Maintenance Work, Concessionaire may perform such Unscheduled Maintenance Work, provided that Concessionaire shall notify FBR’s Representative as soon as possible (and in any event within two [2] Days of the occurrence of the Emergency) of the reasons for and extent of the Unscheduled Maintenance Work.
(b) The Concessionaire shall use commercially reasonable efforts to minimize the duration of such Unscheduled Maintenance Work and its impact upon the performance of the Services. The Concessionaire acknowledges and agrees that Unscheduled Maintenance Work may require work outside of normal working hours in order to accommodate the efficient operation of the Project.
Emergency Maintenance Work. If emergency maintenance work is required to prevent an immediate danger to the employees/property of SVE or to the health or safety of Residents, the SVE may do the work and will ▇▇▇▇ a reasonable cost to the Resident. SVEM may not enter the Resident’s mobile except to respond to an emergency that may cause damage to SVE or other Residents.

Notwithstanding anything contained herein, if the Interconnection Facilities suffer or may suffer an incident, which in the reasonable opinion of Company, constitutes an emergency, Company may conduct such Maintenance Work as it reasonably deems necessary in the circumstances to remedy the emergency, and Company shall notify Supplier as soon as reasonably practicable (including verbally) that such Maintenance Work is ongoing, and if available, the expected duration of the interruption, curtailment or suspension of the operation of the Interconnection Facilities.

(c) Nothing in this Section 26.5 shall prevent IO from making any adjustments to the Interim Monthly Service Payments or Monthly Service Payments, as applicable, in accordance with Schedule 20 - Payment Mechanism.
