Common use of Emergency Maintenance Work Clause in Contracts

Emergency Maintenance Work. ‌ (a) If, as a result of an Emergency, the need arises for Unscheduled Maintenance Work, Concessionaire may perform such Unscheduled Maintenance Work, provided that Concessionaire shall notify FBR’s Representative as soon as possible (and in any event within two [2] Days of the occurrence of the Emergency) of the reasons for and extent of the Unscheduled Maintenance Work. (b) The Concessionaire shall use commercially reasonable efforts to minimize the duration of such Unscheduled Maintenance Work and its impact upon the performance of the Services. The Concessionaire acknowledges and agrees that Unscheduled Maintenance Work may require work outside of normal working hours in order to accommodate the efficient operation of the Project.
