Common use of Emergency Repair Service Clause in Contracts

Emergency Repair Service. (a) DHA will, immediately on becoming aware of it, arrange any emergency works where such work is essential to preserve the Property and/or protect human health, safety and security. (b) If the emergency arises from a repair and maintenance item for which DHA is responsible pursuant to this agreement, DHA must bear the cost of the works. (c) If the emergency is within, or is caused by matters falling within, the Lessor’s retained responsibilities under clause 7, the Lessor must bear the cost of the works. (d) The maximum amount that may be incurred for emergency repairs arranged by DHA without the Lessor’s prior consent is the amount (if any) specified in the Act.
