Common use of Emergency Response and Reporting Clause in Contracts

Emergency Response and Reporting. If any event occurs during performance of the RD Work that causes or threatens to cause a release of Waste Material on, at, or from the Site and that either constitutes an emergency situation or that may present an immediate threat to public health or welfare or the environment, Respondents shall: (1) immediately take all appropriate action to prevent, xxxxx, or minimize such release or threat of release; (2) immediately notify the authorized EPA officer (as specified in ¶ 3.13(c)) orally; and (3) take such actions in consultation with the authorized EPA officer and in accordance with all applicable provisions of the Health and Safety Plan, the Emergency Response Plan, and any other deliverable approved by EPA under the SOW.
