Common use of Emergency Use by Police Department Clause in Contracts

Emergency Use by Police Department. Upon determination of the Chief of the City of Banning Police Department, that an emergency exists requiring immediate use of the entire Premises for training by the Department, Department shall inform Tenant of the emergency and Tenant shall relinquish occupancy, control, and use of the Southern Section of the Premises to the Department. An emergency, as determined by the Chief of the Department, shall not continue for more than one calendar day. Notwithstanding the foregoing, the Chief of the Department may make a determination of emergency on successive calendar days but must inform Tenant each calendar day of the presence of the emergency. For purposes of this section, the term “emergency” shall mean the existence of conditions of disaster or of extreme peril to the health, safety, and welfare of property or residents of the City of Banning.
