Emerging Issues. If both parties agree, UDEQ and EPA will reopen the PPA and amend it to address emerging issues not originally discussed during the PPA negotiations. This “reopener clause” is intended to address new issues that emerge during the PPA period. In addition, during the course of this agreement, UDEQ and EPA will examine how a “reopener clause” will operate for a future, multi-year document.
