Employee Documentation. 19.01 When a formal review of an employee’s performance is made, the employee concerned shall be given an opportunity to discuss and then sign the review form in question to indicate that its contents have been read and understood, a copy of which shall be given to the employee. 19.02 The Employer agrees not to introduce as evidence in a hearing relating to disciplinary action any document from the file of an employee, the existence of which the employee was not aware of at the time of filing. 19.03 Notice of a disciplinary action which may have been placed on the personnel file of an employee shall not be used in relation to any subsequent disciplinary action against that employee if four (4) years have elapsed since the disciplinary action referred to in such notice took place and no further disciplinary action has been recorded during that period. 19.04 Upon written request of an employee, and reasonable notice, the personal file for that employee may be made available at least once per year for his examination in the presence of the responsible administrator. 19.05 Documents submitted by third parties, which are deemed confidential by management and the author shall not be made available to the employee. Other documents submitted by third parties shall be available to the employee.
