Common use of Enforcement; Attorneys’ Fees Clause in Contracts

Enforcement; Attorneys’ Fees. The parties agree to resolve disputes under this Agreement by binding arbitration as provided in Section 28 of the General Conditions, and further acknowledge and agree that by submitting to the alternative dispute resolution process, they intend to surrender their right to have any dispute decided in a court of law by judge or jury. In the event that this Agreement is referred or placed into the hands of attorneys for enforcement of any portion, or if binding arbitration is instituted with respect to a dispute under this Agreement, then the prevailing party shall be paid its reasonable attorneys’ fees and expert witness fees, costs, and all other reasonable expenses in connection therewith.
