Entire Agreement; Counterparts; Facsimile Signatures. This Separation Agreement, and the attached Confidential Information Agreement, constitute and continue the entire agreement and understanding between the Parties concerning Dx. Xxxxxxxxx’x employment with Pharmion, the termination of such employment, and the other subjects addressed herein. This Separation Agreement may not be modified or terminated by Dx. Xxxxxxxxx or Pharmion unless both Dx. Xxxxxxxxx and Pharmion execute a subsequent written agreement terminating or modifying this Separation Agreement. This Separation Agreement may be executed in counterparts, each of which shall be deemed an original instrument, but all of which taken together will constitute a complete instrument. Signatures by facsimile will be deemed to be original signatures for all purposes.
