Common use of Environmental Releases Clause in Contracts

Environmental Releases. Each Interconnected Entity shall notify the other Interconnection Parties, first orally and promptly thereafter in writing, of the release of any Hazardous Substances, any asbestos or lead abatement activities, or any type of remediation activities, related to the Customer Facility or the Interconnection Facilities, any of which may reasonably be expected to affect one or both of the other parties. The notifying party shall (i) provide the notice as soon as possible; (ii) make a good faith effort to provide the notice within twenty-four (24) hours after the party becomes aware of the occurrence; and (iii) promptly furnish to the other parties copies of any publicly available reports filed with any governmental agencies addressing such events.

The notifying party Party shall (i1) provide the notice as soon as possible; (ii) make practicable, provided such Party makes a good faith effort to provide the notice within twenty-four (24) no later than 24 hours after the party such Party becomes aware of the occurrence; , and (iii2) promptly furnish to the other parties Parties copies of any publicly available reports filed with any governmental agencies authorities addressing such events.
