EQUALITY OF OPPORTUNITY IN EMPLOYMENT. 5 Section 2.1. The Hospital shall not discriminate against any employee on account of 6 membership in, or activities for, the Association. Nurses shall not conduct Association 7 business in patient care areas or during hours of work, excluding lunch and break 8 periods taken in non-patient care areas, unless by mutual agreement of management. 10 Section 2.2. The provisions of this Agreement shall be applied without regard to race, 11 religion, color, age, gender, gender identity, national origin, sexual orientation and/or 12 physical or mental impairment which can be reasonably accommodated in all aspects of 13 employment, as required by applicable state or federal law. It is further understood that 14 the Association will cooperate with the Hospital's policy of nondiscrimination in all 15 aspects of employment. 17 Section 2.3. The Hospital shall also continue its policy of prohibiting unlawful 18 harassment, including unlawful sexual harassment. All RNs should report harassment 19 perceived to violate the Hospital’s policy to management immediately. Retaliation 20 against a nurse for opposing discrimination or participating in an investigation of 21 discrimination is also a violation of the policy. 23 Section 2.4. All references to "employees" or "nurses" in this Agreement shall be 24 interpreted to designate both sexes, and whenever the female gender is used alone, it 25 shall be interpreted to include male and female employees.
