Common use of Equipment and Service Software Clause in Contracts

Equipment and Service Software. Customer will comply with any licence agreement relating to Vodafone Software or Third Party Provider terms provided with the Equipment and any end user licence terms specified in the Service Specific Terms relating to the Service or any shrink-wrap or click-through and open source Software licences. If Customer does not accept the terms of the licence of any Software required in order for the Services to be performed, Vodafone will be excused from performing any Services relying on such Software. Where Software is subject to a Software licence, the terms of the Software licence shall comprise Customer’s sole rights and remedies.
