Common use of Equipment Procurement Clause in Contracts

Equipment Procurement. If responsibility for construction of Transmission Provider's Interconnection Facilities or Network Upgrades is to be borne by Transmission Provider, then Transmission Provider shall commence design of Transmission Provider's Interconnection Facilities or Network Upgrades and procure necessary equipment as soon as practicable after all of the following conditions are satisfied, unless the Parties otherwise agree in writing: 5.5.1 Transmission Provider has completed the Facilities Study pursuant to the Facilities Study Agreement; 5.5.2 Transmission Provider has received written authorization to proceed with design and procurement from Interconnection Customer by the date specified in Appendix B, Milestones; and 5.5.3 Interconnection Customer has provided security to Transmission Provider in accordance with Article 11.5 by the dates specified in Appendix B, Milestones.

Equipment Procurement. If responsibility for construction of the Transmission Provider's Owner’s Interconnection Facilities or Facilities, Network Upgrades and/or Distribution Upgrades is to be borne by the Transmission ProviderOwner, then the Transmission Provider Owner shall commence design of the Transmission Provider's Owner’s Interconnection Facilities or Facilities, Network Upgrades and/or Distribution Upgrades, and procure necessary equipment as soon as practicable after all of the following conditions are satisfied, unless the Parties otherwise agree in writing: 5.5.1 The Transmission Provider has completed the Interconnection Facilities Study pursuant to the Interconnection Facilities Study Agreement; 5.5.2 The Transmission Provider has received written authorization to proceed with design and procurement from the Interconnection Customer by the date specified in Appendix B, Milestones, for Transmission Owner to proceed with design and procurement; and 5.5.3 The Interconnection Customer has provided security to the Transmission Provider Owner, with notice provided to Transmission Provider, in accordance with Article 11.5 by the dates specified in Appendix B, Milestones.

If responsibility for construction of Transmission Provider's Owner’s Interconnection Facilities or Network Upgrades is to be borne by Transmission ProviderOwner, then Transmission Provider Owner shall commence design of Transmission Provider's Owner’s Interconnection Facilities or Network Upgrades and procure necessary equipment as soon as practicable after all of the following conditions are satisfied, unless the Parties otherwise agree in writing: 5.5.1 Transmission Provider has completed the Facilities Study pursuant to the Facilities Study AgreementInterim Availability Interconnection System Impact Study; 5.5.2 Transmission Provider Owner has received written authorization to proceed with design and procurement from Interconnection Customer by the date specified in Appendix B, Milestones; and; 5.5.3 Interconnection Customer has provided security to Transmission Provider in accordance with Article 11.5 11.7 by the dates specified in Appendix B, Milestones; and 5.5.4 The Parties have executed this Interim GIA.
