Common use of Equipment Procurement Clause in Contracts

Equipment Procurement. If responsibility for construction of the Transmission Owner’s Interconnection Facilities, Network Upgrades and/or Distribution Upgrades is to be borne by Transmission Owner, then Transmission Owner shall commence design of 5.5.1 Transmission Provider has completed the Interconnection Facilities Study pursuant to the Interconnection Facilities Study Agreement; and 5.5.2 Where applicable, Interconnection Customer has provided security to Transmission Owner in accordance with Article 11.6 by the dates specified in Appendix B, Milestones.

If responsibility for construction of the Transmission Owner’s Interconnection Facilities, Network Upgrades and/or Distribution Upgrades is to be borne by Transmission Owner, then Transmission Owner shall commence design ofto 5.5.1 Transmission Provider has completed the Interconnection Facilities Study pursuant to the Interconnection Facilities Study Agreement; and 5.5.2 Where applicable, Interconnection Customer has provided security to Transmission Owner in accordance with Article 11.6 by the dates specified in Appendix B, Milestones.

If responsibility for construction of the Interconnecting Transmission Owner’s Interconnection Facilities, Facilities or Network Upgrades and/or Distribution Upgrades is to be borne by Transmission Owner, then by 5.5.1 The Interconnecting Transmission Owner shall commence design of 5.5.1 Transmission Provider has completed the Interconnection Facilities Study pursuant to the Interconnection Facilities Study Agreement; and 5.5.2 Where applicable, The Interconnecting Transmission Owner has received written authorization to proceed with design and procurement from the Interconnection Customer has provided security to Transmission Owner in accordance with Article 11.6 by the dates date specified in Appendix B, B (Milestones).
