Common use of Establishment of Regular Positions Clause in Contracts

Establishment of Regular Positions. a) As a general practice, term appointments shall not be used to supplant regular appointments for work of a continuing rather than a term-certain nature. Where a position has been established on a single or recurring term basis for a period of three (3) years, the position shall become a regular position and filled with a regular appointment at the end of the three (3) year period unless there is no further funding for the position or the University determines that the position is no longer required. This provision will not apply where a staff member is replacing a regular staff member on an approved absence. b) Where the work is a term certain project or where a person is employed in a sequence of differentiated term certain projects, the University may approach the Association to have the provisions of this article waived and this waiver shall not be unreasonably withheld by the Association. c) The University will provide the PEA an annual list of all term positions that includes: position numbers and start and end date, incumbents’ names, and start date of the incumbents in the position and at the University. This will be provided in an electronic format. d) The University and the Association will, each May, review all term positions.
