Appointment and Promotion. A Faculty Member shall ordinarily spend a minimum number of years in each rank before becoming eligible for the next higher rank, and he or she must demonstrate a standard of excellence appropriate to the rank sought.
Appointment and Promotion. Regardless of the length of appointment, no Bargaining Unit Faculty Member is eligible for tenure under any circumstances, and nothing in this Agreement implies tenure.
Appointment and Promotion i. When it is proposed to make an appointment or promotion to a new or vacant position within the organisation structure of the council, the position must be advertised in a manner sufficient to enable suitably qualified persons to apply for the position. This subclause applies to the appointment of any employee where the term or terms of employment are for more than 12 months in any period of 2 years.
ii. When the decision is being made to appoint a person to a position:-
a) Only a person who has applied for an appointment to the position may be selected; and
b) From among the applicants eligible for appointment, the applicant who has the greatest merit is to be selected.
iii. The merit of the persons eligible for appointment to a position is to be determined according to:-
a) The nature of the duties of the position; and
b) The abilities, qualifications, experience and standard of work performance of those persons relevant to those duties.
iv. Where requested in writing, internal applicants shall be given the reasons in writing for not being appointed.
v. Subclauses (i), (ii) and (iii) of this clause do not apply to any appointment which is made by way of demotion or lateral transfer unless the council decides that those subclauses are to apply to the appointment.
vi. If a position within the organisation structure of a council is vacant or the holder of such a position is sick or absent, the council may appoint a person to the position temporarily. A person appointed to a position temporarily shall not continue in that position for a period of more than 12 months.
Appointment and Promotion. 35.1 The provisions of the Award shall apply.
35.2 Additionally, in the case of externally advertised positions, where an identical vacancy occurs within 6 months of filling of the previous vacancy (i.e. date of verbal acceptance), the merit list from the original recruitment process can be reactivated at managements discretion.

(a) This subclause shall not apply to circumstances in accordance with the provisions of Clause 348 of the Local Government Act 1993.

iv. Where requested in writing, internal applicants shall be given the reasons in writing for not being appointed and are able to request a review of their individual education and training needs.
v. Subclauses i., ii. and iii. of this clause do not apply to any appointment which is made by way of demotion or lateral transfer unless Council decides that those subclauses are to apply to the appointment.
vi. If a position within the organisation structure of Council is vacant or the holder of such a position is sick or absent, Council may appoint a person to the position temporarily. A person appointed to a position temporarily shall not continue in that position for a period of more than 12 months.

Regardless of the length of appointment, no Bargaining Unit Faculty Member (meaning NTE Bargaining Unit Faculty Member here and elsewhere in Article 13 NTE “Appointment and Promotion”) is eligible for tenure under any circumstances, and nothing in this Agreement implies tenure.
Appointment and Promotion. 13.1 Regardless of the length of appointment, no Bargaining Unit Faculty Member is eligible for tenure under any circumstances, and nothing in this Agreement implies tenure.
13.1.1 Each Bargaining Unit Faculty Member not appointed in the College of Nursing and Health or the Lake Campus will have a primary appointment in an identified academic department.
13.1.2 Clinical Instructor and Clinical Assistant Professor are the ranks assigned only to those who teach courses in the College of Nursing and Health. Initial appointments are for three years and may be extended by a succeeding three-year appointment. Faculty may be appointed to the rank of Clinical Instructor or Clinical Assistant Professor upon beginning Xxxxxx State employment, depending on their credentials and experience.
13.1.3 Bargaining Unit Faculty have either fixed-term or continuing appointments.
13.1.3.1 Instructors and all ranks of Visiting Professors always have fixed-term appointments.

Appointment and Promotion. 31.1. Where an internal applicant has applied for a new or vacant position and their application is unsuccessful, the employee may:
(i) request in writing the reasons as to why they were not appointed; and
(ii) upon such request KEE will provide the reasons in writing.
